. and this president has made unprecedented use of them. nbc news has obtained a government document that lays out the legal argument to justify the president's use of drones to kill al qaeda suspects, including, in some cases, u.s. citizens. our national investigative correspondent michael isikoff broke the story and has our report. >> reporter: drones have been called president obama's weapon of choice. during his four years as commander in chief, u.s. military and cia drone strikes have accelerated at an unprecedented pace. more than 400 cia strikes against targets in pakistan and yemen. eight times as many as under president bush. >> they have been very precise, precision strikes against al qaeda and their affiliates. >> these strikes are legal. they are ethical. and they are wise. >> reporter: but today, new questions about drone strikes targeting american citizens, including anwar al awlaki. born in new mexico and killed in yemen in 2011. he allegedly directed the so-called underwear bomber, who tried to blow up an airliner over detroit in 2009. but awlaki was never charged with a crime. nbc

evening on this saturday night. it's great to have you with us. we begin this evening with that standoff playing in the small town in alabama. at the center of it all, a little 5-year-old boy for five days now has been held under ground in a bunker, pulled off a school bus, out of the front seat where he loved to seit is. teams of law enforcement have arrived standing watch. neighbors lighting candles standing vigil. as temperatures are expect td to plum met, authorities are saying little about how they can get this boy out. abc's gio benitez. >> reporter: five days into this dramatic standoff, we're learning that hostage taker jimmy lee dykes has been in constant contact with negotiators. letting them send things to that little boy held hostage, 5-year-old ethan. >> he's also allowed us to providing color books, medication, toys. and i want to thank him for taking care of our child. >> reporter: it's unclear what kind of medication, but the boy reportedly has adhd and a form of autism. police don't think that dykes has physically harmed the boy. but we know that he has crying. there are

news faster, we will turn to jackies sizzle who joins us live. >> they're not going to have classes' here today because of this investigation. they're still trying to determine what happened and there are a few details that are coming out right now. we just spoke with someone from alameda police department and they stated that about 8:45 p.m. they received a call about fires being shot on this street. ted that when they arrived they discovered that one victim had a gunshot wound and that they were transported to a hospital where he died of his injuries. there is not a lot of descriptions for the victim. he was a young adult and that is about it for right now. because of the time of when that happens crime scene investigators were out but obviously they were waiting to get a break to come so that they can investigate more. this is why the schools will remain closed for today. you will see that there will be a search of the grounds and that we will have canine units out. they will do a real search. >> this is what we're seeing out here right now within the last 15 to 20 minutes more r

, everyone. i'm randi kaye, glad you're with us. we begin this morning with news about the shooting death of a former nav former naval s.e.a.l. chris kyle was killed yesterday along with another person at a gun range near ft. worth, texas. local newspapers also confirm the death. wfaa reports a former marine suffering from posttraumatic stress disorder is being held in connection with the shootings. these are pictures of kyle taken from the security company kraft international. kyle recounted his four combat tours in iraq in his book "american sniper." his more than 150 sniper kills had them placing a bounty on his head. most recently he appeared on the reality show "stars earn stripes" and conan o'brien show. >> you were so well known by the iraqi insurgents that they put a $20,000 bounty on your head, is that right? >> yes, sir. >> how did the iraqi insurgents identify who you were? >> when i'd go into a house and we had occupied houses, i would take the top of my uniform off and just have my short sleeve shirt on and youed and see my tattoo coming down my arm and they identified that w
